David M. Rosen
Of Counsel
David M. Rosen, of counsel in Prince Lobel’s Litigation Practice Group, brings to the firm more than 20 years of civil litigation experience. David’s practice focuses on providing banks, mortgage holders, and loan servicers with personal, hands-on representation in all phases of mortgage and real estate-related litigation. He is admitted in state and federal court in Massachusetts and Rhode Island, and frequently appears in Bankruptcy Court and in the Massachusetts Land Court.
By working closely with his clients, David implements case strategies designed to quickly bring the case to finality while minimizing cost and reputational risk. David focuses on finding practical solutions to even the most complex problems. Drawing on his extensive experience resolving claims through settlement, David utilizes alternative dispute resolution, mediation, and loss mitigation. For those cases that cannot be resolved by settlement, David will aggressively take the case to trial.
David has represented clients in a wide range of matters involving injunctions, consumer protection claims, challenges to standing, wrongful foreclosure, debt disputes, adversary complaints, breach of contract, negligence, fraud and misrepresentation, identify theft, TILA, RESPA, Fair Debt, Federal Forfeiture, contested eviction, code violation, tax and mechanics liens, deficiency claims, condo/HOA litigation, and interpleader actions. He has also worked on a wide range of equity and title matters.
Prior to joining Prince Lobel, David managed the litigation department at a mortgage foreclosure law firm. As the primary point of contact for firm clients, David made all initial case assessments, developed litigation strategies, and provided risk analysis and budget estimates. By providing this type of oversight, David could assure clients that their cases and interests were being closely managed from the big picture down to the smallest detail.
As the managing attorney, David personally handled the firm’s high risk cases, and also mentored his team of attorneys in all aspects of civil and trial procedure, and in areas of substantive law. He was also the liaison with members of the foreclosure, eviction, bankruptcy, and closings departments.
Earlier in his legal career, David represented many private money lenders, banks, and financial institutions in civil litigation and eviction work. He has also worked as a criminal defense attorney and on employment discrimination claims. David resides in the western suburbs of Boston with his wife and two children, and is active in coaching youth athletics. Bar Admissions- United States Court of Appeals for the First Circuit
