Joseph P. Calandrelli
Associate
Joe
Calandrelli's practice includes representing clients in the financial services,
construction, real estate, public transportation, communications, internet
marketing and health care industries. Joe has handled diverse
actions involving contracts, personal injury and premises liability torts, and
business torts. These cases have involved claims for substantial monetary
damages, and a range of personal injuries, including everything from minor
contusions and emotional distress to permanent disfigurement and wrongful
death.
Joe
also represents financial services companies in claims brought under the
various state and federal laws relating to the origination and collection of
mortgage loans. Joe regularly defends claims brought in both state and federal
court by aggrieved borrowers under the Truth In Lending Act, the Consumer
Credit Cost Disclosure Act, the Predatory Home Loan Practices Act, RESPA, the
Borrower's Interest Statute, Fair Debt Collection Act, and G. L. c. 93A, among
others. By relying on his extensive knowledge of these various laws, Joe
strives to develop strategies at the outset of a case, which will provide his
clients with a quick and cost-efficient dismissal or other resolution of the
claim. He has successfully obtained orders of dismissal on numerous issues
involving all aspects of these laws, most notably helping to further clarify
Massachusetts case law relating to the recoupment doctrine.
Finally,
Joe represents general contractors, subcontractors, developers, bonding
companies, and property owners in connection with a wide range of complex civil
matters. In addition to litigation, Joe also advises owners, contractors, and
developers in all aspects of the construction process, including negotiation,
arbitration, and contract development.
Prior
to joining Prince Lobel, Joe was a law clerk to the Justices of the
Massachusetts Superior Court, during which time he assisted the justices in
drafting decisions in both civil and criminal cases. While at law school, Joe
was a summer associate at Prince Lobel.
